I leased [address redacted] from July 20, 2009 to July 19, 2010. I submitted a security deposit in the amount of $XXX (one month’s rent). Upon turning in my keys on Monday, July 19, 2010, I completed the “key return” form your office provided and included a forwarding address. I asked one of your staff members when I could expect my security deposit returned. I was told 45 days.
According to section 55-248.15:1 of the Virginia Residential Landlord and Tenant Act (VRLTA), “The security deposit, any accrued interest and any deductions, damages and charges shall be itemized by the landlord in a written notice given to the tenant, together with any amount due the tenant within 45 days after termination of the tenancy and delivery of possession.”
It has been 57 days as of Monday, Sept. 13, and I still have not received written notice of any kind, or my security deposit. Given that I left the unit in better condition than when I moved in, and the fact that I was never late with a payment, I would appreciate the immediate return of my deposit, in full. I am aware of my rights and understand that I may be entitled to interest equal to one percentage point below the Federal Reserve Board discount rate as of January 1, 2010. I also understand that you may be responsible for any legal fees I incur should this matter go to court.
